What happened

Version 5.0 of the AI Risk Evaluation Supplement, formerly the AI Systems Evaluation Tool, was open for 30 days of public comment ending September 29.

The NAIC's Big Data Working Group exposed version 5.0 of its AI Risk Evaluation Supplement for a 30-day public comment period that ends September 29, 2026, according to McDermott Will & Emery. The supplement was previously called the AI Systems Evaluation Tool. It is meant to give state examiners a standard way to review how an insurer governs its AI during a market conduct or financial exam.

What is verified

The source's own statement, as linked above. Nothing beyond it has been independently checked by us.

What remains unclear

This is an exposure draft, not an adopted framework. No state has made it part of its exams on the strength of this draft. It is addressed to insurers, not producers. We have not read the draft itself; this item relies on a law firm's summary.

What it means for your book

Carriers should expect examiners to ask for an AI inventory, model documentation and testing records once a final version is adopted. Agencies and MGAs with delegated authority may get those questions from their carriers before a regulator asks them directly.

  • Carriers: check whether your AI inventory would answer an examiner's request today, including tools bought from vendors.
  • MGAs: ask your carrier partners whether they plan to request AI documentation under your delegated authority agreements.
